When mediation does not help: the boundary between meeting and coercion

A joint meeting is not a universal solution. Consent to participate does not require concession; threats call for separate support, while this article cannot establish a particular process’s suitability. Help can exist without imposed contact or a promise of safety.

Questions explored

Does refusing a meeting mean refusing the task?

Not necessarily: subject and proposed format differ; this article does not determine legal duties.

Can this article verify the safety of separate rooms or an online meeting?

No. Particular suitability requires separate assessment; a description of professional practice is no guarantee.

Must all reasons for refusal be disclosed to the other person?

No. Dangerous disclosure and a joint experiment are not proposed as conditions for help.

Is the benefit of the practical questions established?

No. They are voluntary editorial reflection, not a tested technique or complete safety plan.

Key distinctions

A third person’s presence and equal speaking time do not themselves establish voluntary participation. (United Wisdom)

Consent to address a task, enter a format and accept an outcome are different decisions. (United Wisdom)

FMC identifies safety risk as a possible reason family mediation is unsuitable; England and Wales scope, not a universal legal procedure. (Family Mediation Council)

The FMC blog describes separate initial assessment and review; past abuse is not declared an automatic lifelong ban, precautions do not guarantee safety. (Louisa Whitney / FMC)

Neutrality need not ignore conditions of refusal; silence does not prove voluntariness. (United Wisdom)

Erasmus compares costs of war and agreement; historical criticism, not a contemporary risk-assessment procedure. (Erasmus)

Separate help need not lead to a joint meeting; a remaining task does not grant unconditional access to a person. (United Wisdom)

Immediate danger requires a local emergency route; no joint experiment/disclosure prescribed, particular availability unverified. (United Wisdom, current NHS support context)

Practice is voluntary and not efficacy-tested; religious and Stoic connections retain distinct foundations. (United Wisdom)
