Criminal organisation, network and individual offence: what do we mean by a system?
An episode, a legal group definition and an analytical network need different grounds. The international framework supplies no private case finding. Drug cartels and competitors’ collusion concern different subjects. Acquaintance alone does not establish participation. Assistance with present harm need not await a complete account of the setting.
Questions explored
Do three acquaintances already constitute organised crime?
No. Article2(a) combines several elements;the number alone replaces neither purpose, activity nor the remaining elements. No national-law assessment of particular people was conducted.
Is organisation impossible without a single boss?
No. The Convention requires no formal roles or developed structure, and analytical models vary. Missing form also supplies no independent proof of criminal activity.
Does a network line establish someone’s participation?
Its meaning matters. Kinship, lawful communication, instructions, receiving threats and knowing assistance differ;proximity on a diagram adds no facts about a role.
Do drug cartels and business cartel collusion have identical arrangements?
A shared word establishes no identity. One concerns illicit drug trafficking, the other restricted competition between competitors. Structure, evidence and responsibility require separate consideration.
Must assistance await the complete picture and a legal finding?
No. Present needs and harm can be recognised while knowledge of other circumstances remains limited. This promises neither legal outcomes nor confidentiality nor a safe recipient.
Key distinctions
Events, legal classification and recurring arrangements need different grounds;Plato supplies no naturally criminal human kinds, and an unproven network does not cancel particular harm.
The Convention combines article 2(a) elements;four years concerns maximum punishment, formal roles are unnecessary, article 3 differs from article 34(2), and no individual national-law finding is supplied.
Analytical models vary and are no offence definition;distributed actions alone establish no shared knowledge, discipline alone establishes no criminal purpose, and missing formal offices do not exclude coordination.
Network lines need meaning, time and source;networks are wider than criminal typology, receiving a threat alone establishes no participation in a common plan, dependence grants no universal exemption, and dangerous gathering/safe channels are not assumed.
Repetition alone does not establish a common cause, invented examples supply no statistics;an author mechanism is no offence, weak consideration proves no shared criminal agreement, and case numbers are no organisation degree.
Drug cartels and anticompetitive collusion concern different subjects;a common name proves no unified structure, prices alone establish no agreement, employees receive no automatic attribution, and profit similarity is no identity.
Participation concerns knowledge, intention and conduct under article 5 alternatives;objective inference needs no confession, acquaintance alone establishes no participation, brief versions are no verdict, and help/dignity await no spotless biography.
E02/R48 supply related context, no new established legal facts;kinship, culture and territory alone establish no shared guilt, rejecting romantic legends requires no stigma, and assumption/charge/fact statuses remain distinct.
Proverbs supplies a limited ethical parallel, no contemporary procedure or required victim confrontation;help awaits no complete classification, known and reported facts differ, and revising explanations erases no established harm.
System descriptions need a specified subject and inference boundary;small questions demand no entire-life disclosure, organisation removes no responsibility automatically, and distinctions retain dignity despite incomplete maps.
Limits of interpretation
- No investigation or finding of individual criminal liability;dangerous tests, restricted information and obtaining admissions are unnecessary.
- An international definition supplies no national-law finding;maximum punishment is no minimum sentence, and formal structure is unnecessary. Ratification, national provisions and practice remain unchecked.
- Analytical typology is no statutory offence or current global prevalence;the philosophical parallel establishes no naturally criminal human kinds.
- The ancient ethical parallel supplies no modern procedure or required victim confrontation;confidentiality and safe recipients remain unverified.
