Hierarchy, family clan and brokered network: different ways of distributing power
Hierarchy, family ties and brokerage highlight different aspects of power and can combine. Each model separates decisions, benefits and consequences. Rank, received resources and proximity alone establish neither knowledge nor a legal role. Consequences can affect non-choosing people. Models do not replace consideration of a particular case.
Questions explored
Does hierarchy put every decision and all knowledge at the top?
No. Overall purpose, terms, local discretion and information about outcomes differ. Rank alone establishes neither knowledge of every episode nor ignorance at lower levels.
Does a family-clan model give relatives inherited guilt?
No. It examines specified ties in a criminal setting, not an inherently criminal family or culture. Non-choosing relatives may suffer; children are no equal parties to adult agreements.
Are everyone’s options equal and free in a brokered network?
Distribution alone establishes no equality or freedom. Access and choice can differ; connection, payment, knowledge and control need separate grounds.
Can one model explain everything?
Actual relationships can combine across levels. Specify a model’s subject and limits; do not invent additional roles simply to complete a picture.
Does receiving benefit automatically mean bearing all responsibility?
Resources, actions, knowledge, will and legal liability differ. A person can suffer without participating. No universal guilt calculation or private income-based verdict follows.
Key distinctions
A messenger’s name differs from actual authority; Confucius supplies a limited role question, no duty of criminal obedience. Promised and received benefits differ, and consequences exceed penalties and can affect non-choosing people.
Hierarchical decisions span levels but rank establishes no complete knowledge; benefits need not follow visible work, a small share makes no harm harmless, and consequences can affect visible participants and victims more strongly.
Discretion has a specified subject; information need not match rank, promised promotion is no received benefit, and prosecuting leaders and stopping particular harm are no single guaranteed result.
Kinship and personal ties can channel decisions, but the cultural model exceeds a blood family; collective benefit proves no equal access. Consequences can affect non-choosing relatives without inherited guilt; children are not treated as equal parties to an adult agreement.
Symbolic family establishes neither kinship nor reciprocity; one agreement creates no unlimited duties, promised access is no performance, and conflict can affect several dependencies without a name alone determining legal roles.
Brokerage can connect without overall command; distributed decisions establish no equal options, payments prove no complete control or automatic knowledge, and consequences can extend beyond agreements without a pre-established hidden centre.
Models can combine across levels; Europol 2026 supplies a bounded observation, no reader-role finding. Claimed power, confirmed influence and desired benefit differ; an incomplete map is neither collective conviction nor collective justification.
Benefit, conduct and responsibility differ. Article 10 distinguishes legal persons’ and individuals’ liability; it establishes no verdict against every worker or automatic organisational shield for personal conduct. Transferred burdens are no deserved punishment; Europol selection is no random global sample or probability of a reader’s role.
Role names establish no fairness; Dhammapada supplies a limited ethical question, no guilt through tears or inevitable retribution. All three models retain cost questions; coercion needs separate consideration without a moral-purity test or promised universal legal exemption.
Each model needs distinct decision/benefit/consequence questions; rank, income and kinship supply no complete role. Known, reported and unknown differ, E02/R48 give no new proof, and dignity/help await no complete map.
Limits of interpretation
- Three analytical models are no three human types or ready-made legal findings; no family investigation or instructions for organising crime.
- Confucius supplies no modern equal-rights model or duty of criminal obedience; Dhammapada establishes no guilt through tears, rightness without regret or inevitable retribution.
- The cultural model extends beyond blood family and establishes no inherently criminal people; Europol selects most threatening EU-affecting networks, no random global sample or reader-role probability.
- Article 10 supplies no company/all-worker verdict; applicable law and personal cases remain unchecked. Confidentiality/safe recipients remain unverified, and urgent help awaits no completed analysis.
