Recruitment through an intermediary: agency, transporter and employer roles at home and abroad

Job matching, agency employment for a third company, transportation, instructions, pay and legal duties differ. Domestic and cross-border situations are examined with obligations towards an intermediary: intermediation is not itself crime and gratitude is no unlimited consent. The later stage is conditional, with no rapid restoration promised.

Questions explored

Does every agency become the employer?

No. The Convention distinguishes matching without joining the employment relationship from agency employment for a third company. A label is insufficient; local implementation and Marina’s case are unverified.

Does a transporter know all work conditions and participants?

Transportation alone establishes no such knowledge. Customer, payment, communication, knowledge and decisions are unspecified for Marina’s transporter; the role does not make every driver an employer or criminal.

Do fee rules cancel every debt to an intermediary?

No. A qualified norm and separate non-binding principles establish no cancellation of every debt; Marina’s duties/amounts are unknown and safe disregard is unselected.

Do a clear explanation and weakened constraints mean help and rapid restoration?

No. Understanding is not fulfilment, and contact/message/help differ. The later stage is conditional, without established exit/end of all dependence or promised rapid restoration.

Key distinctions

Article 1 of ILO Convention 181, adopted 19 June 1997, distinguishes matching without the agency becoming a party to employment from agency employment for a third company assigning/supervising tasks.

  • The agency label identifies no arrangement; particular national status/regulation, ratifications, exclusions, current implementation and Marina’s case are unverified, with seafarers outside the named scope. A lawful agency is no criminal network.

Convention 181 Article 12 places allocation of agency/user-company duties within national law/practice; non-binding 2016 principles collected 2019 call for lawful allocation understood by workers.

  • This is no identical universal responsibility for everything or verified compliance for Marina. Current instructions, power to change contracts/determine pay and responsibility for conduct differ; her payer/remuneration/arrears are unknown.

ILO guidance includes transport within recruitment and covers domestic/cross-border matching directly/through intermediaries; a separate cross-border variant adds differing requirements rather than crime.

  • Not every driver is an employer/recruiter/criminal; Marina’s transporter’s customer/payment/communication/knowledge/decisions are unspecified. Foreign travel is not added to her biography; the variant establishes no nationality/work authorization/contract/lawful journey.

Convention 181 Article 7 contains a general rule against charging workers and competent-authority conditional exceptions; separate non-binding ILO principles do not place recruitment costs on workers. Real help does not verify every later amount or demand.

  • No automatic cancellation of every debt follows; applicable rules/exceptions/amount grounds and Marina’s obligations are unknown, with safe disregard unselected. Gratitude requires neither unconditional acceptance of new assignments nor a dangerous conversation.

OHCHR’s official 20 February 2026 release describes false job offers followed by forced fraud through interviews/events 2021–2025. Different roles do not establish identical knowledge/common intention, while different occupations do not remove assessment of a particular act.

  • The release, rather than the full report, was read; this is no finding about every agency/transporter/employer or a finding that Marina is a victim.   • Services/access/confidentiality/protection/legal outcomes and safe actions are unverified; contact/message/help differ, and personal investigation is not required. No exit/end of all dependence or rapid restoration of trust/work/reputation/intimacy is established or promised. Earlier help does not make every old connection safe or require immediate contact; another person’s consent remains distinct.

Limits of interpretation

  • Marina is a fictional adult within a country, not a source participant. Agency/transport/current instructions are given; legal employer/payer/contract/authority/knowledge/intentions/debt/deception/crime/coercion/nationality/status are unknown. Foreign travel is no event in her biography.
  • Ratifications, exclusions, current local implementation and individual application are unverified; principles are non-binding and the release is not the full report. Sources establish no universal responsibility, cancellation of every debt or immunity.
  • Services/payment/access/confidentiality/protection of relatives/legal outcomes are unverified; safe refusal/conversation/approach/disclosure/mediation/exit are unselected, contact/message/help differ and dangerous chain testing is not required.
