Changing an account, cooperating with authorities and witness protection: specific legal settings, without promises
Clarifying what is known, withdrawing support, a cooperation agreement and protection are separate questions. A promise establishes neither authority nor actual assistance. The US federal examples distinguish non-prosecution from WITSEC; England-and-Wales court anonymity has particular conditions. Possible responsibility and protection needs can coexist, while translation changes no jurisdiction.
Questions explored
Does changing an account always mean lying?
Error, clarification, retraction and intentional distortion require circumstantial distinctions; new knowledge does not make a prior record automatically a deliberate lie, while pressure adds no missing knowledge.
Does retracting an original assertion prove it false?
In the specialised CPS guidance examined, retraction alone cannot establish falsity; not wanting to support prosecution differs from asserting that an event never occurred.
Do non-prosecution discussions guarantee US federal witness security?
The federal guidance examined distinguishes non-prosecution and WITSEC; an intermediary’s promise or preliminary conversation establishes neither admission nor assistance actually operating.
Does England-and-Wales court anonymity mean absolute secrecy?
The guidance examined gives court anonymity conditions A–C and retains a fair trial; an application, decision and measure’s content differ, and a legal label guarantees no absolute technical secrecy.
Can protection be needed while personal responsibility remains unresolved?
Protection needs and one’s actions can require consideration together; fear establishes no responsibility, needing help implies no admission of guilt, and cooperation is not declared to cancel every consequence.
Key distinctions
Error, clarification, retraction and intentional distortion require circumstantial distinctions; new knowledge does not make a prior record automatically a deliberate lie, while pressure adds no missing knowledge.
- Official checking-before-signing guidance does not grant a general right to independently rewrite submitted records and determines neither later-change consequences nor personal rights.
In the specialised CPS guidance examined, retraction alone cannot establish falsity; not wanting to support prosecution differs from asserting that an event never occurred.
- The source concerns rape and domestic abuse in the area examined; it is neither every witness’s complete regime nor promised freedom from prosecution or case closure.
The federal guidance examined distinguishes non-prosecution and WITSEC; an intermediary’s promise or preliminary conversation establishes neither admission nor assistance actually operating.
- This is the US federal area; internal principles create no independent entitlement to a desired decision, and a witness label determines no complete set of personal rights and duties.
The guidance examined gives court anonymity conditions A–C and retains a fair trial; an application, decision and measure’s content differ, and a legal label guarantees no absolute technical secrecy.
- The mechanism is not transferred to federal US proceedings; safety needs and another participant’s rights coexist, and no identity-concealment methods are supplied.
Protection needs and one’s actions can require consideration together; fear establishes no responsibility, needing help implies no admission of guilt, and cooperation is not declared to cancel every consequence.
- A profession’s name does not guarantee independence; no conversation is promised confidential, and competence in one country does not establish it in another. No safe pause or consequence-free approach is established.
Limits of interpretation
- Examples concern the US federal system and England and Wales; personal rights, duties and case outcomes are not determined. No advantageous account, fabricated accusation, coordinated witnesses, destroyed traces, access to others’ material or circumvention of requirements is supplied. Safe refusal, pausing, reporting and publicity, recipient independence, absolute confidentiality, protected status and absence of responsibility are not guaranteed. Under immediate danger, available protection of people takes priority over the exercise.
