A criminal group within an armed structure: service hierarchy and informal dependence
Service hierarchy and informal dependence can overlap while retaining different grounds. Affiliation proves no universal participation in an alleged group, and office excuses no arbitrary private demand. Personal role, knowledge, pressure and consequences need separate consideration. Earlier assistance creates no endless debt; ending one assignment and actual protection are different results.
Questions explored
Are service hierarchy and informal dependence identical?
The same person can assign ordinary work and make a private demand in another capacity; position, resources, sponsorship and threats do not establish one complete lawful authority.
Must a criminal group have a formal hierarchy?
In the UNODC educational explanation examined, formal hierarchy is unnecessary; the absence of an official list does not prove that no group exists, while friendship or pooled money proves no crime.
Does official capacity create a general exemption?
Selected Rome Statute Article 27 grants no exemption through official capacity itself under the Court’s regime; a position cannot simply certify protection for a private demand.
Does earlier assistance oblige every new assignment?
Gratitude and previous participation create no endless debt to a private network; possible past responsibility grants others no control over a person’s future.
Do an accepted enquiry, promised measure and received protection coincide?
An accepted enquiry is no assistance actually received, conversation is no proceeding begun and a promised measure is no protection operating; one explained question can leave others unresolved.
Key distinctions
The same person can assign ordinary work and make a private demand in another capacity; position, resources, sponsorship and threats do not establish one complete lawful authority.
- Overlap proves no universal crime and excludes no possible organisational duties; facts about the demand matter rather than a single collective name.
In the UNODC educational explanation examined, formal hierarchy is unnecessary; the absence of an official list does not prove that no group exists, while friendship or pooled money proves no crime.
- This is a bounded educational Convention reference, no complete domestic test or finding about the fiction; failing one definition does not make every act lawful.

Gratitude and previous participation create no endless debt to a private network; possible past responsibility grants others no control over a person’s future.
- Actual service duties need separate grounds; ending a private assignment does not itself establish lawful discharge or employment termination, proves no safety and erases no consequences.
An accepted enquiry is no assistance actually received, conversation is no proceeding begun and a promised measure is no protection operating; one explained question can leave others unresolved.
- A label, recommendation or payment establishes no independence; no improvised investigation or wholesale data disclosure is proposed, and absolute secrecy and safe reporting are not promised.
Limits of interpretation
- This article determines neither guilt, membership, jurisdiction, immunities outside the selected regime nor personal service duties; the Convention reference is no complete domestic test. It supplies no theft, sale, recruitment, sabotage, escape, dangerous testing, independent investigation, unauthorised access, covert collection, destroyed or altered information or coordinated accounts. Assistance’s independence, competence, availability and absolute confidentiality, safe refusal, pausing, publicity and reporting, an end to all pressure and freedom from responsibility are not promised. Under immediate danger, available protection takes priority over the exercise.
