Illicit trade and diversion of weapons from a combat zone: between supply, records, coercion and responsibility
Diversion, a record mismatch and illicit transfer differ; signing creates no missing knowledge. Treaty provisions on state records do not turn every worker into a control authority, while authorisation settles no complete lawfulness. Coercion needs its own consideration without general justification or accusation. Inner clarity, an ended act, a lawfully ended role and assistance received have different limits.
Questions explored
Does a record mismatch confirm a weapons sale?
A record discrepancy establishes neither cause, an object’s fate nor a participant; clarifying a record does not necessarily establish the object’s fate or every earlier action’s lawfulness.
Does authorisation necessarily make a transfer lawful?
UNODC uses diversion for a firearm’s movement from the legal into the illicit realm and cautions that authorisation does not automatically make a transfer lawful; a label, stamp or office settles no complete circumstances.
Do treaty records provisions make every worker a state controller?
Arms Trade Treaty Articles11–12 address state subjects within their scope; they do not give every worker state powers or identical duties for every record.
Does a threat automatically remove every consequence?
Threat, actual options, knowledge and conduct need different questions; coercion establishes neither automatic guilt nor exemption from every responsibility, while assistance and serious consideration of conduct can coexist.
Must a relative supply every assessment and protection?
Closeness creates no expertise in every record, power or weapons movement; support can concern one question, while conversation, an accepted enquiry and actual protection have different limits.
Key distinctions
A record discrepancy establishes neither cause, an object’s fate nor a participant; clarifying a record does not necessarily establish the object’s fate or every earlier action’s lawfulness.
- The scene preselects neither mistake, incomplete information nor crime and performs no audit; a records question grants no right to inspect, count or move dangerous objects, while correction needs applicable grounds.

Threat, actual options, knowledge and conduct need different questions; coercion establishes neither automatic guilt nor exemption from every responsibility, while assistance and serious consideration of conduct can coexist.
- No universal threat test or safe refusal is supplied; others’ needs and rights remain, while an inner boundary is neither lawful discharge, release from service nor all consequences ended.
Closeness creates no expertise in every record, power or weapons movement; support can concern one question, while conversation, an accepted enquiry and actual protection have different limits.
- Relatives retain consent, resources and safety; dangerous contact, storage and transport are not required, with no unauthorised access, restricted copying, destroyed/hidden/altered information or coordinated accounts proposed; independence, competence, absolute secrecy and protection are not promised.
Limits of interpretation
- This article establishes no particular transaction, guilt, service status, order validity or applicable law; it surveys neither particular shipments, conflict sides nor diversion scale. It supplies no acquisition, transfer, export or concealment methods, control evasion or record manipulation; no independent inspection, storage, transport, dangerous-object testing, dangerous contact or investigation. No unauthorised access, restricted copying, destroyed, hidden or altered information or coordinated accounts are proposed. Actual preservation, disclosure and procedural duties require applicable law and competence. A recipient’s independence, competence, authority and availability, safe refusal, pausing, reporting and publicity, absolute secrecy and actual protection are not promised. Under immediate danger to people, available urgent assistance takes priority over the exercise.
