Support for making decisions and representation

Short answer

Help understanding information, help expressing one's answer and action in one's name are different matters. Needing accessible explanation or communication without speech does not itself authorise a supporter to decide. Formal representation needs applicable grounds and has limits. The article determines no individual's capacity, status or consent validity.

Argument and questions

I–III: Alisa, an adult disabled since childhood, asks about price while her supporter answers “we agree”. Zinaida asks about bills while her son starts discussing a move. Neither fictional scene establishes a diagnosis or unlawful action. They reveal a transition from assistance to an attributed answer.

Which frameworks are compared? IV: CRPD12 and General commentNo.1(paragraphs12–29) concern equal legal capacity, support, will and preferences. The Committee's opposition to substitution and objective adult best interests differs substantively from the England and Wales mechanism described by NHS/GOV.UK. International interpretation is not presented as automatically cancelling a domestic order.

What does a document confer? V–VI: a particular power under applicable local rules, rather than general authority through kinship. Translating deputy/attorney/guardian does not establish identical roles. Access to information differs from power to decide everything it concerns.

Does participation end after appointment? VII–IX: no; distinguish the person's position, a professional finding and the representative's preference, consider conflicts, relevant scrutiny and actual current assistance. A concern raised differs from conditions changed.

X–XI: HobbesXVI distinguishes actor and represented person; historical exclusions and his model of liability are not adopted as contemporary rights. Luke16:1–13 concerns entrusted matters and faithfulness, neither appointing authority nor justifying deceit. These foundations are not merged with current law.

Practice and limits

For one action, ask accessibly what is being explained, how my answer is expressed, and who acts in my name on which grounds. A written dossier, family, money or previous independence is not required. Unknown grounds should be reported as unknown to the receiving institution; a contact is not support received. A child is not the reserve representative. This is no capacity test, appointment form, permission to sign for someone or justification for withholding necessary care to test independence. Urgent needs require an appropriate urgent route without waiting for a family or legal dispute to end.
