Criminal motorcycle clubs: membership, loyalty and life beyond the club

Does a club symbol or “one percent” prove a crime?

Do a constitution and community work guarantee club safety?

Does gratitude require carrying out every new instruction?

Do ethical distinction and weaker dependence promise rapid restoration?

The Fifth Circuit decision of 5 August 2020 places Bandidos' foundation in San Leon, Texas, in March1966 and describes local chapters/national functions with differing testimony over presidential authority.

• The factual account views evidence favourably to the jury verdict, rather than independently surveying clubs; it gives no full archival history, identical present structure across countries or joining/identification instructions.

The USAO release of 24 September2018 reports Portillo's sentence and Portillo/Pike jury convictions; the 2020 appeal affirmed the challenged judgment. The court distinguishes guilt through association alone from circumstances/knowledge/participation relevant to a particular conspiracy. “One percent” is reported as testimony/description, not a measured share of all motorcyclists or proof through a symbol.

• These are no judgments against every member, acquaintance or relative or verification of all later proceedings. The distinction is not a blanket prohibition on circumstantial evidence, does not make every relationship automatically irrelevant, creates no immunity and supplies no ready test for every country.

Earlier help transfers no authority over an entire future. Loyalty in a commitment, a new request's content, knowledge, conduct and pressure differ; a member's request does not automatically become criminal.
